Terms and Conditions of Use

BumbyBoom is a reverse marketplace platform that facilitates connections between buyers and sellers of fashion, beauty, and home decor products. The platform allows users:

• Buyers: to publish requests for desired products, receive offers from sellers, and choose the best offer.
• Sellers: to list products, make offers on buyer requests, and sell directly.

BumbyBoom acts exclusively as a technical intermediary and is not a party to the sale-purchase contracts concluded between users. The platform does not own, market, or deliver the listed products.

To use the platform features, you must create an account. By registering, you guarantee that:

• You provide accurate, complete, and up-to-date information.
• You do not use another person's identity or false information.
• You do not create multiple accounts for abusive purposes.
• You maintain the confidentiality of your password and access credentials.

You are responsible for all activities that occur in your account. You must immediately notify us if you suspect unauthorized use of your account.

The platform's content, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, is the property of BumbyBoom or its licensors and is protected by copyright and intellectual property laws in Romania and the European Union.

You are not permitted to reproduce, distribute, modify, publicly display, transmit, or create derivative works based on the platform's content without the prior written consent of BumbyBoom.

Products listed by sellers remain their property. Sellers warrant that they have the right to sell the listed products and that they do not infringe upon the intellectual property rights of third parties.

As a platform user, you undertake to:

• List only genuine products, in the described condition, and honor the description provided.
• Do not publish counterfeit, illegal, prohibited products, or those infringing third-party rights.
• Respect the delivery and payment terms agreed with other users.
• Do not manipulate prices, ratings, reviews, or rankings.
• Do not send spam, abusive, threatening, or unauthorized commercial messages to other users.
• Do not attempt to circumvent the platform's commissions, fees, or security measures.
• Do not use the platform for illegal or fraudulent activities.

The following categories of products may not be listed, offered, or traded on the BumbyBoom platform:

• Counterfeit, pirated, replica, or illegally copied products.
• Weapons, ammunition, explosives, or dangerous devices.
• Prohibited substances, drugs, prescription medications without a prescription.
• Live animals, protected plants, or endangered species.
• Products infringing intellectual property rights (fake brands, trademarks used without authorization).
• Pornographic, violent, obscene, or offensive content.
• Personal data, confidential information, or official documents.
• Stolen goods or goods obtained through illegal means.

We reserve the right to remove any listing that violates these rules, without prior notice and without liability on our part.

All transactions carried out on the platform are subject to the following conditions:

• Payments are processed through authorized payment partners (Stripe, PayPal), in accordance with PCI DSS standards.
• BumbyBoom does not store credit card data — these are processed directly by the payment processor.
• Funds are held in escrow until the buyer confirms receipt of the product.
• Upon delivery confirmation, funds are released to the seller, minus applicable fees.
• The easybox delivery fee is 9.99 lei, regardless of product quantity or weight.
• Returns can be made within 14 days of receiving the package, in accordance with applicable legislation.

The platform is provided "as is" and "as available". BumbyBoom makes no express or implied warranties regarding:

• Uninterrupted or error-free operation of the platform.
• Accuracy, completeness, or reliability of the content.
• Quality, safety, or legality of products listed by sellers.
• User behavior or fulfillment of obligations assumed by them.

In no event shall BumbyBoom, its administrators, employees, or partners be liable for direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the platform.

BumbyBoom is not responsible for the content, actions, or inactions of its users, including failure to fulfill delivery, payment, or return obligations.

These terms and conditions are governed and interpreted in accordance with Romanian law. Any dispute arising from or in connection with the use of the platform shall be first resolved amicably.

If an amicable agreement cannot be reached within 30 days of initiating negotiations, the dispute shall be resolved by the competent courts of Bucharest, Romania.

For consumers, they benefit from the protection offered by European and Romanian legislation on distance selling and may resort to the alternative dispute resolution (ADR) procedure under GEO 38/2015.

BumbyBoom reserves the right to suspend or terminate any user's access to the platform who violates these terms and conditions, without prior notice and without liability.

You may delete your account at any time from the platform settings. After deletion, data required for legal obligations (tax records, transaction history) will be retained in accordance with applicable legislation.
